The ruling was made in the Wynberg Magistrates’ Court on Thursday.
Iain Wares stands accused of dozens of sexual abuse charges in Scotland. The 85-year-old reportedly taught pupils of Edinburgh Academy and Fettes College in the 1960s and 70s. Now, he faces 74 charges in Scotland.
He is also accused of sexually and physically abusing a Grade 7 learner at Rondebosch Boys Prep in 1988.
His charges include lewd and indecent behaviour, as well as one charge of indecent assault.
As per the judgement, Wares could be extradited on three of seven charges raised in South Africa, the BBC reported.
However, he could not be extradited on the other four charges, as they were ‘too far in the past’ and had expired under South African law at the time of their issuance.
South Africa’s Minister of Justice, Thembi Nkadimeng, must now decide on the ruling.
A Cape Town court initially found him extraditable in 2019 but he appealed the decision, resulting in this week’s court judgement.
